Terms of Service

§ 1 General Provisions

  • These Terms of Service define the rules for using the CNC Technical Drawing Analyzer website (hereinafter: “Service”), operated by STUPAK Serwis Łukasz Stupak with its registered office at ul. Rzeczna 84, 55-003 Nadolice Wielkie, NIP: 8981988698, REGON: 529130760 (hereinafter: “STUPAK Serwis”).
  • The Service is intended for CNC industry professionals and provides automatic analysis of technical drawings in accordance with ISO standards using advanced computer vision algorithms.
  • A User of the Service may be any natural person, legal entity, or organizational unit without legal personality that has registered an account in the Service and uses its services (hereinafter: “User”).

§ 2 Definitions

The terms used in these Terms of Service shall have the following meanings:

  • Service – a SaaS platform for automatic analysis of ISO technical drawings for the CNC industry, available at the web address specified by STUPAK Serwis.
  • User Account – an individual account in the Service created after registration, enabling access to analytical services.
  • Analytical Service – automatic analysis of technical drawings in PDF format using advanced computer vision algorithms to extract technical data such as: material, dimensions, tolerances, holes, surface finish.
  • FREE Plan – a free plan with a limit of 20 analyses per month.
  • PRO Plan – a paid plan with a limit of 100 analyses per month.
  • ENTERPRISE Plan – a plan dedicated to larger organizations with an individually determined analysis limit.
  • Analysis Session – a single analysis request covering one or more PDF files uploaded by the User.

§ 3 Technical Requirements for Using the Service

  • To use the Service, you need: a device with Internet access, a current version of a web browser supporting cookies and JavaScript, an active email address.
  • The User is obliged to use the Service in accordance with its intended purpose, these Terms of Service, applicable laws, and good practices.
  • It is prohibited for the User to provide unlawful content or to take actions that compromise the security or stability of the Service.
  • STUPAK Serwis makes every effort to ensure the proper functioning of the Service, however, it is not liable for interruptions in access to the Service caused by technical reasons or other circumstances beyond STUPAK Serwis's control.

§ 4 Registration and User Account

  • Using the Analytical Services requires creating a User Account by registering in the Service.
  • To register, the User is required to provide the following data: first and last name, company name, email address, password.
  • Providing personal data is voluntary, but necessary for creating an account and using the Service.
  • The User is obliged to keep the Account access password confidential and bears full responsibility for all actions performed using their Account.
  • In case of suspected unauthorized access to the Account, the User is obliged to immediately notify STUPAK Serwis and change the password.
  • STUPAK Serwis may introduce an optional email address verification process to confirm the User's identity.

§ 5 Electronic Services

  • STUPAK Serwis provides the following electronic services through the Service: User Account management, Analytical Service – automatic analysis of technical drawings in PDF format, storage of analysis history and results, interface for viewing and editing analysis results, email notifications about analysis status.
  • The Analytical Service includes: conversion of PDF files to image format (PNG), automatic drawing orientation detection (Tesseract OCR technology), analysis of drawing content using computer vision algorithms to extract data: material, overall dimensions, tolerances, holes (diameter, thread type, length), surface finish, quantity, and other technical parameters compliant with ISO standards, result validation according to the Service data schema, saving results in the database with metadata.
  • Analysis results may require verification and editing by the User in a dedicated interface.
  • The basic service (FREE Plan) is free of charge. PRO and ENTERPRISE Plans are paid according to the current price list.

§ 6 Plans and Usage Limits

  • The Service offers the following plans: FREE Plan – limit of 20 analyses per month, free; PRO Plan – limit of 100 analyses per month, paid; ENTERPRISE Plan – individually determined limit, paid, dedicated to larger organizations.
  • Usage limits refer to the number of Analysis Sessions (uploaded PDF files) in a given calendar month.
  • After exhausting the monthly limit, the User cannot request further analyses until the limit is renewed (new calendar month) or the Plan is upgraded.
  • Unused analyses in a given month do not carry over to the next month.
  • Details regarding plans, prices, and payment methods are available in the “Pricing” section of the Service and upon User request.

§ 7 File Upload and Processing

  • The User may upload PDF files containing technical drawings to the Service.
  • Uploaded files are validated for: format (required: PDF), size (limit specified in the Service), number of pages (limit specified in the Service), PDF file structure correctness.
  • The User declares that they have all necessary rights to the uploaded files and that their content does not infringe the rights of third parties or applicable laws.
  • It is prohibited to upload files containing unlawful, offensive, pornographic content, or content otherwise violating good practices.
  • File processing is performed asynchronously using a task queue (Redis Queue). Processing status is available in the User interface in real-time (Server-Sent Events technology).
  • STUPAK Serwis is not liable for the quality of analysis results in case of low-quality uploaded files, illegible drawings, or drawings not compliant with ISO standards.

§ 8 Data and Results Storage

  • Uploaded files and generated analysis results are stored on STUPAK Serwis servers for the time necessary to provide the Service and in accordance with applicable laws.
  • Access to stored files and results is available only to the User (after logging into the Account) and authorized STUPAK Serwis employees to the extent necessary to provide the Service.
  • Image files (PNG) generated from PDF files are not publicly available. Access to images is only through authenticated API requests.
  • The User has the right to delete their data, including uploaded files and analysis results, by contacting STUPAK Serwis or using the deletion function available in the Service.
  • After deleting the User Account or upon User request, STUPAK Serwis undertakes to delete all uploaded files and analysis results within 30 days, subject to legal obligations.

§ 9 Liability

  • STUPAK Serwis makes every effort to ensure the Service operates continuously and correctly, however, it does not guarantee: 100% Service availability (possible technical and maintenance breaks), error-free automatically generated analysis results, full accuracy of results in every case.
  • Analysis results are generated automatically and may contain errors. The User is obliged to verify results before using them in production processes.
  • STUPAK Serwis is not liable for damages resulting from: User's use of the Service contrary to the Terms of Service, unauthorized or improper access to the User Account, errors in analysis results caused by low quality of uploaded files, force majeure or actions of third parties (e.g., DDoS attacks, infrastructure provider failures).
  • STUPAK Serwis's liability is limited to the amount of fees paid by the User for the month in which the damage occurred, excluding liability arising from mandatory legal provisions.

§ 10 Intellectual Property Rights

  • All rights to the Service, including copyrights, database rights, trademark rights, and industrial property rights, belong to STUPAK Serwis or third parties with whom STUPAK Serwis has concluded relevant agreements.
  • Using the Service does not transfer any intellectual property rights to the User regarding the content contained in the Service, interface, source code, or algorithms.
  • The User may use the content contained in the Service only within the scope of permitted personal use related to business activities.
  • Any other use of content contained in the Service, including copying source code, distribution, modification, decompilation, reverse engineering, requires prior written consent from STUPAK Serwis.
  • Copyrights to files uploaded by the User remain the property of the User. STUPAK Serwis processes uploaded files only for the purpose of providing the Analytical Service.

§ 11 Complaints

  • The User has the right to file complaints regarding the functioning of the Service or the quality of provided Services.
  • Complaints can be submitted: electronically to email: [email protected], in writing to the address: STUPAK Serwis Łukasz Stupak, ul. Rzeczna 84, 55-003 Nadolice Wielkie.
  • A complaint should include: data identifying the User (first name, last name, email address assigned to the Account), description of the problem or irregularity, date of occurrence of the problem, User's request.
  • STUPAK Serwis will process the complaint within 14 business days from the date of receipt and will inform the User of the result at the email address provided in the complaint.
  • If it is not possible to process the complaint within the above period, STUPAK Serwis will inform the User of the reasons for the delay and the expected processing time.

§ 12 Contract Termination and Account Deletion

  • The User may at any time stop using the Service and request Account deletion by contacting STUPAK Serwis at: [email protected].
  • STUPAK Serwis may terminate the Service and delete the User Account in case of: gross violation of the Terms of Service by the User, uploading unlawful content or content infringing third party rights, taking actions threatening the security of the Service, User inactivity for a period longer than 24 months (with prior notification).
  • In case of Account deletion, all uploaded files and analysis results will be permanently deleted within 30 days, subject to STUPAK Serwis's legal obligations.
  • For paid Plans (PRO, ENTERPRISE), additional contract termination conditions specified in the agreement or payment terms apply.

§ 13 Personal Data and Privacy

  • The data controller for User personal data is STUPAK Serwis Łukasz Stupak, ul. Rzeczna 84, 55-003 Nadolice Wielkie.
  • Personal data provided during registration and while using the Service is processed in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR) and the Personal Data Protection Act.
  • Detailed information on personal data processing, including purposes, legal bases, retention period, and User rights, is contained in the Privacy Policy available in the Service.
  • The User has the right to: access their personal data, rectify data, delete data (“right to be forgotten”), restrict processing, data portability, object to processing, lodge a complaint with a supervisory authority.
  • The Service uses cookies. Detailed information is contained in the Cookie Policy available in the Service.

§ 14 Final Provisions

  • STUPAK Serwis reserves the right to change these Terms of Service at any time. Changes may result in particular from technological development, changes in legal regulations, or expansion of Service functionality.
  • Users will be notified of planned changes to the Terms of Service via email to the address assigned to the Account or through a message in the Service, at least 7 days before the changes take effect.
  • Changes to the Terms of Service take effect on the day of their publication in the Service. Continued use of the Service after the changes take effect constitutes acceptance of the new Terms of Service.
  • A User who does not accept the changes to the Terms of Service has the right to terminate the agreement and delete the Account before the date of the changes taking effect.
  • Matters not regulated by these Terms of Service shall be governed by Polish law, in particular: the Act of 18 July 2002 on the provision of electronic services, the Act of 23 April 1964 Civil Code, the Act of 4 February 1994 on copyright and related rights.
  • All disputes arising from the use of the Service shall be resolved by the court having jurisdiction over STUPAK Serwis's registered office.
  • The Terms of Service shall come into force on the day of publication in the Service.
